NY Online Gambling 2021

Gambling in New York has long been an unregulated activity and it took years for the state to legalize any form of gambling. The first to go was horse racing, where bettors could engage in pooled betting systems and bets were only allowed at the track. Since then, New York has made some changed to their legal betting standpoints and simulcast betting is also allowed, along with some gaming machines.

While there are a number of land-based casinos and racetracks in the state, online gambling remains options remain limited in NY. Read more to find about your current betting choices in the Empire State.

In New York, there may be rigid laws pertaining to online gambling, but NY residents have long enjoyed the thrills of live horse race betting and there are some great tracks in the state that support real money wagers on races.

All racing activities that take place in the state are overseen by the New York State Racing and Wagering Board and this includes off-track betting, harness racing, quarter horse racing, and thoroughbred racing.

Many of the top-rated racetracks in NY offer simulcast races, so bettors have the chance to place wagers on events that are being held all over the world, increasing their chances of winnings and enhancing the betting experience.

Even though the state has not yet approved any type of sports betting, the NY Gaming Commission is already working on regulations that would be in place when the time comes. The regulations should include mobile betting, as this will offer a huge increase in revenue once the state agrees to legalize betting.

Unfortunately, things are being stalled by the current governor, who has not been supportive of any form of online betting or gambling. We will have to wait and see what 2021 brings and hope that a sports gambling legislation could be included in a future state budget.

However, there is talk that it is being considered. While the state will be behind a number of other early adopters should it decide to offer any sports betting online, there are no definite plans at this time. For the moment, residents of NY are restricted to land-based betting and some online horse race betting options.

Based on the success enjoyed by other states who do offer online casinos and online sportsbooks, it is apparent that New York is missing out on millions in possible revenue. Read about the state of NY online casinos with this article.

The longer the state waits to pass laws, the more money they lose as bettors will simply take their business into Pennsylvania or across the bridge into New Jersey where they can visit multiple casinos in Atlantic City that offer sports betting as well as online access.

NY Online Casinos & Poker

Which Online Casino Games can I Play in New York?

At this time, online casino games are not legal in New York. However, many are hopeful that New York will legalize online casinos just like NY Sportsbooks. But until then, New Yorkers are hopeful they can soon play the following games online:

  • Video Poker: one of the most popular online casino games
  • Online Slots: online slot machines are incredibly easy to learn how to play online
  • Table Games: Classic table games are staples of online casinos
  • Online Bingo: The traditional game we all grew up playing is offered on most online casinos.

Online Poker in New York

NY Online Poker is not yet legal, just like NY Online Sports Betting. However, luckily for online poker fans, a bill has been introduced by New York State lawmakers to allow for online poker to be legally played using real money. This would change the definition of online poker from a game of chance to a game of skill. If lawmakers should legalize online poker, New York online betting sites will hopefully be soon behind.

Many of the best online sportsbooks have sports betting apps already. However, these sports betting apps are typically only available for iOS/iPhone devices as well as Android. But, these apps are still forced to follow the same rules as the sports betting sites. You must be of legal age to gamble in your state as well as within the state boundaries where online betting is legal, plus the website needs to be licensed to operate in your state.

The NY Sports Betting Sites that launch apps will probably follow similar structures. You will need to meet the system requirements to download the app, which is usually having the proper operating system as well as sufficient memory for the app.

Common NY Online Gambling Questions

How does the PASPA Act play a role in NY Online Gambling?

In 1992, the US Congress passed PASPA which froze betting laws in place. The only state that continued to offer legal sports betting was Nevada. However, in 2018, PASPA was finally reversed, allowing individual states the ability to offer online sportsbooks to residents.

New Jersey was the first state to start offering this type of betting and this was followed by a few other states. New York was not the first out of the gate, but the Empire State is methodically moving towards legal online sports betting.

When sports betting services are legalized for online bettors, it would start by creating retail bookies at the four commercial casinos in the state. Since these are the only venues that are allowed to take any wagers, any online betting site will have to be associated with these locations.

Lawmakers are trying to move forward with the offering of legal sports betting since the PASPA has been repealed, albeit, slowly.

Should the state decide to get on board, the repeal of PASPA opens the door to the ability to operate betting sites and generate revenue, which would surely help the economy as well as the operating casinos and racinos that are already established in the state.

Are Sports Betting Regulations being drafted?

Even though the state has not yet approved any type of sports betting, the NY Gaming Commission is already working on regulations that would be in place when the time comes. The regulations should include mobile betting, as this will offer a huge increase in revenue once the state agrees to legalize betting.

Unfortunately, things are being stalled by the current governor, who has not been supportive of any form of online betting or gambling. We will have to wait and see what 2020 brings and hope that a sports gambling legislation could be included in a future state budget.

Is Playing Daily Fantasy Sports Legal in NY?

New York Supreme Court Acting Justice Gerald Connolly issued a ruling that the state’s daily fantasy sports law unconstitutional and “in violation of the anti-gambling provision”.

The state of New York has had a complicated history with the daily fantasy sports industry with a former Attorney General moving to crack down on DraftKings and FanDuel in 2015.

But in 2016, New York’s daily fantasy sports were defined as games of skill. But because there exists a material degree of chance in these types of contests, the state legislature didn’t have the constitutional authority to approve them without voter consent. The legislature passed the New York Gaming Economic Development Act of 2013, and the governor signed it into law July of that year.

What about NY Sports Betting & Legalization Process?

The gambling regulations timeline for NY Online Sports Betting is still very much a work in progress. Though many states including neighboring New Jersey and Pennsylvania have embraced things like online casinos and sports betting, New York online casinos and New York online betting still does not exist. Bills are currently being introduced to try to allow for online sports wagering like the ones from Senator Joseph Addabbo and Assemblymen Gary Pretlow.

As of right now, New York State law reads that “a person engages in gambling when he or she stakes or risks something of value upon the outcome of a contest of chance or a future contingent event not under his or her control or influence, upon an agreement or understanding that he or she will receive something of value in the event of a certain outcome.” The new proposed law would allow third-party sportsbook operators to offer online sports betting as a sort of agent for any New York casino that is licensed.

The proposed bill would make it so New York sports betting licenses would cost $15 million each at a tax rate of 8.5% on gross revenue from gaming. But, customers in New York would not be able to bet on any in-state college teams and events. There is also something known as the integrity fee included with this NY sports betting sites legislation. This means that professional sports leagues would receive 0.20% of the total betting handle. This would make New York the first state to implement this type of fee.

Part of the reason why this NY Online Sports Betting is taking so long is that New York does not allow an expansion of gambling regulations without an amendment first. And, it requires approval from 2 consecutive legislatures before it will then go to a vote from state residents.

Where am I able to bet on sports in NY?

If you are curious as to what NY Sportsbooks and NY Sports betting sites will open up first, you just have to look at the New York Casinos that are currently land-based casinos in the state. Many of these land-based NY Casinos are just waiting for their chance to open up NY Online Sports Betting Sites. So, here are the land-based casinos most likely to jump into the New York online betting market.

  • Akwesasne Mohawk Casino Resort
  • Batavia Downs Gaming & Hotel
  • Del Lago Resort & Casino
  • Empire City Casino
  • Finger Lakes Gaming & Racetrack
  • Hamburg Gaming
  • Lakeside Entertainment
  • Resorts Wolrd Catskills
